20. Assisting with settlement preparations, trial preparations and trail proceedings
An experienced legal nurse consultant will assist the client and legal team in preparing
- Trial notebooks
- Settlement letters
- Settlement brochures with exhibits and demonstrative evidence
- Function as an educator/resource person for medical issues and assist in identifying inconsistencies
In settlement proceedings, the legal nurse consultant can assist the attorney by reviewing, extracting, interpreting, and summarizing important information from the medical records and discovery documents to address in the demand letter and exhibits.
In trial preparation the legal nurse consultant will identify pertinent documents and records and update summaries and chronologies as needed. The legal nurse consultant will also assist in preparation of trial and witness notebooks.
During the trial, the legal nurse consultant will assist the client by:
- Taking detailed notes from testimony
- Identifying areas that need further questioning or explanation
- Identifying inconsistencies in witness testimony
- Observing the jury during case presentation
- Completing additional research and document retrieval as needed
